Operating License No. DPR-73 Docket No. 50-320 State of New Jersey Department of Energy Board of Public Utilities Order of Approval for GPU Nuclear Corporation Please find enclosed a copy of the Order of Approval issued by the State of New Jersey Department of Energy Board of Public Utilities (NJBPU) dated October 14, 1981 for the proposed operating agreements providing for the operation of the Three Mile Island and Oyster Creek Nuclear Stations by GPU Nuclear Corporation. Additionally, copies of the approvals issued by the Securities and Exchange Commission, the Federal Energy Regulatory Commission and the Pennsylvania Public Utility Commission were previously submitted as an attachment to Technical Specification Change Request No. 31. Therefore, all necessary approvals other than the NRC's have been obtained and have been provided to you for your information.
Please note, however, that provision two appearing on page four of the Order of Approval issued by the NJBPU states that Jersey Central Power and Light Company "shall not implement the agreements if any NRC license terms and conditions or other regulatory requirements of the NRC y
prevent their terms and conditions as approved hereby".

MU In light of this limitation and of the administrative unfeasibility of activating GPU Nuclear Corporation with less than all of the Units for which it will ultimately have responsibility, it has been determined that it will be impossible to conclude the transfer of responsibility for TMI-2 to CPU Nuclear Corporation until NRC approval has been obtained for all the nuclear stations, i.e. Three Mile Island Nuclear Station Units No. 1 and 2 and Oyster Creek Nuclear Station, affected by the change to GPU Nuclear Corporation. Accordingly, it is requested that the NRC not fix an effective date for the change over to GPU Nuclear Corporation for TMI-2 until requisite license admendments for all three units mentioned above have been 8112160Y/94
