DENIAL OF REQUEST FOR A SEALED SOURCE AND DEVICE REGISTRATION CERTIFICATE AND EXEMPT DISTRIBUTION LICENSE FOR GUN SIGHTS CONTAINING TRITIUM
Dear Mr. Erdle:
This is in reference to Harrison Reed Inc.s applications dated January 30, 2017. Your applications requested an exempt distribution license and a sealed source and device registration certificate for gun sights containing hydrogen-3 (tritium).
In a letter dated February 18, 2019, (available in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20023A451) the U.S. Nuclear Regulatory Commission (NRC) informed you that your pending applications would be denied if the following information was not provided to the NRC within 20 days from the date of that letter:
- 1.
Written documentation of payment of the civil penalty imposed on October 22, 2019, to Dead Ringer, LLC and
- 2.
A detailed discussion of how the NRC would be confident that the issues identified in NRCs letter to you dated August 8, 2019, would not recur.
As of the date of this letter the NRC has not received the information requested. Therefore, pursuant to 10 CFR 2.103, Action on applications for byproduct, source, special nuclear material, facility and operator licenses, your applications are hereby denied. In accordance with 10 CFR 2.103(b)(2), you may request a hearing within 20 days of this letter.
