Your July 27, 1976 letter stated that it-ap-

peared that certain of our activities were not conducted in full compliance.with NRC requirements.

tivities were enclosed as Appendices A & B to your letter.

With respect to the item identified in Appendix A, the follow-Ing is offered:

During the Inspector's review of the test results of the

power ascension program, he noted that field changes to the test procedures were not being approved in accordance with l

INT-TP-ADMIN-1.0, The Administrative Guidelines for the Test l

Program".

ADMIN-1.0 requires that field changes be jointly

(

agreed to by Wedco and the con Ed Test Supervisor who is the l

Watch Foreman after the issuance of an operating license.

Contrary to this requirement, personnel other than the Watch Foreman had approved several non-safety related changes.

The changes approved were either clerical or non-safety related.

The personnel making the changes were the Con Ed shift Test Engineers who were considered to be more techni-cally qualified to make these types of changes since they were involved in the preparation and approval of the origi-nal procedures.

Inspection 50-286/78-29 This refers to the inspection conducted by Mr. E. Jones of this office on October 2-6, 1978, at Indian Point 3 Nuclear Power Plant, of activities authorized by NRC License No. DPR-64 and to the discussions of our findings hsid by Mr. Jones with yourse'f and Mr. B. Weiser of your staff at the conct,usion of the inspection.

Areas examined during this inspection are described in the Office of St Inspection and Enforcement Inspection Report which is enclosed with this ND letter. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations by the inspector.

Based on the results of this inspection, it appears that certain of your activities were not conducted in full compliance with NRC requirements, as set forth in the Notice of Violation, enclosed herewith as Appendix A.

These items of noncompliance have been categorized into the levels as described in our corresponder.ce to you dated December 31, 1974.

This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

Section 2.201 requires you to submit to this office, within twenty (20) days of your receipt of this notice, a written statement or explanation in reply including:

(1) corrective steps which have been taken by you and the results achieved; (2) corrective steps which will be taken to avoid further items of noncompliance; and (3) the date when full compliance will be achieved.
