Inspection 50-320/80-12

This refers to the routine inspection conducted by Mr. R. Conte of this

office on July 6 - August 31, 1980, of activities authorized by NRC License

No. DPR-73 and to the discussions of our findings held by Mr. Conte with

Mr. E. Kunder and other members of your staff at the conclusion of the

inspection, and to a subsequent telephone discussion between Mr. J. Allan

of this office and yourself on September 16, 1980.

This telephone discussion

resulted in an immediate action letter issued on September 17, 1980, confirming

our understanding of your commitments to upgrade the emergency preparedness

capability at the TMI Unit 2 site.

Areas examined during this inspection are described in the Office of

Inspection and Enforcement Inspection Report which is enclosed with this

letter.

Within these areas, the inspection consisted of selective examina-

tions of procedures and representative records, interviews with personnel,

measurecents made by the inspector, and observations by the inspector.

Within the scope of this inspection, no items of noncompliance were observed.

However, certain activities appear to be deviations from commitments made with

respect to the Submerged Demineralizer System.

These deviations are described

in the Notice of Deviation enclosed as Appendix A and further discussed in

paragraph 8.b of the enclosed inspection report.

You are requested to respond

to this letter.

Please include your comments concerning these items, a description

of any steps that have been or will be taken to prevent recurrence, and the date

by which all corrective actions or preventive measures were or will be completed.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and the enclosures

will be placed in the NRC's Public Document Room.

If this report contains

any information that you (or your contractor) believe to be proprietary, it

is necessary that you make a written application within 20 days to this

office to withhold such information from public disclosure. Any such

application must be accompanied by an affidavit executed by the owner of

l

the information, which identifies the document or part sought to be withheld,

l

and which contains statements of reasons which addresses with specificity

l

the items which will be considered by the Commission as listed in subparagraph (b) (4)

l

of Section 2.790. The information sought to be withheld shall be incorporated
