In reviewing CAW-80-31 and its enclosures, we find the only proprietary information is contained in the first sentence of Note 3, Page 4 Revision 0 of Attachment 5 preceding the semi-colon, which will be withheld from public disclosure. The portion of the sentence following the semi-colon is not considered prnprietary.

Accordingly, we have concluded that the information sought to be withheld frca public disclosure other than that stipulated above, does not meet the requirements of 10 CFR 2.790. Therefore, your request to withhold the information submitted by Crd-30-31 fran public disclosure is denied.

In not less than thirty (30) days from the date of this letter, the subject documents will be olaced in the Public Doce: rent Rcoms.

If, within thirty (30) days of the date of this letter, you request withdrawal of the documents in accordance with 10 CFR 2.790(c), your request will be considered in the light of applicable statutes and regulations and a determination made whether the docu' ents will be withheld fran the Public Document Room and returned to you.

we received Westinghouse, proprietary and non-proprie, August,13,1980,,tary version By Duke Power Company letter, dated related to Electrical Equipnent Qualification and Westinghouse affidavit, CAW-CO-31. The letter requested witnholdi'ng frtm public disclosure pursuant to 10 CFR 2.790 and further requested that corresoondence concerning CAW-80-31 be addressed to Westinghouse Electric Corporation.

Your reason for withholding this info at on was that public disclosure of 1e information would substantially harm the' competitive position of Westinghouse and would enhance the ability of coninetitors to design, manufature and sell electrical equipment for comertial power reactors without incurring similar expenses. Public disclos'ure of the information would enable Westinghouse competitors to use the infopation for ifcensing documentation without purchasing the result of many years of research and the expenditure of a considerable amount of money. This information could only be duplicated by a competitor if,a similar sum of money were invested in tima and research.

We have reviewed your application and meterial based on the requirements and criteria of 10 CFR 2.790 and have determined that the above-mentioned document sought to be withheld contains trade secrets on confidential or proprietary comercial information.

We also have found at this tine that the right of the oublic to be fully aporised as to the bases for and effects of the pronosed action does not outweigh the demonstrated concern for protection c# your comoetitive position.

Accordingly, we have determined that the information should be withheld from public disclosure, l

. We therefore approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding the proprietary Infonnation Related to E4ectrical Equipment Qualification transmitted by Duke Power Cocoany on August 13, 1980 from public inspection as proprietary.

Withholding from public inspection shall not effect the right, if any, of persons properly and directly concerned to inspect the documents.

If the need arises, we may send copies of ththinfonnation to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreenents for handling proprietary data.

If the basis for withholding thH infonnation from public insoection should change in the future such that the infonnation could then be made available for public inspection, pha should promptly notify the NRC.
