DOCK.c,T h0. 50-10 By letter dated June 26, 1973, the Commonwealth Edison Company (CEC) transmitted a proprietary report entitled " Response to Request for Auditional Information dated Juae 12, 1973," and requested that the report be withheld from public disclosure pursuant to 10 CTR 2.790(b).
nita a letter dated August 21, 1973, CEC filed a non-proprietary version of this report relating to densification of Dresden i fuel.
la its letter dated June 26, 1973, CEC se,ated that the proprietary report "contains some information that was developed at the expense of Gulf United and which secures their competitive position in the industry", and therefore should be withheld from public disclosure.
Af ter reviewing the proprietary and the non proprietary versions of the report and attempting to achieve an effective balance between legitimate concerns for protection of Gulf United's conjetitive position and the right of the public to be fully apprised as to the operation of Dresden Unit 1 and its related changes and safety issues, we have concluded that Commonwealth Edison Company has cade a sufficient showing that Gulf United's interest could be adversely affected by disclosure of the inforcation contained in the proprietary report. We also have concluded that sufficient inforcation is contained in the non-proprietary version filed with CEC letter dated August 21, 1973, and in other non proprietary documents in the public record of Inocket lio. 50-10 to advise an interested member of the public on the operation of,Dresden Unit 1, its fuel densification problet and applicable safety considerations.

Jasec on the above, I have concluded that disclosure of the proprietary report is not required in the public interest nor by 10 CD'. Part 9, cna it should therefore be withheld from public' inspection pursunnt to 2.790(b) of 10 CFR Part 2.
