Dear Ms. Steves:

We have reviewed the final revisions to the Kansas Administrative Regulations in Sections 28-35-135, 28-35-178, 28-35-179, 28-35-181, 28-35-192, and 28-35-197, received by our office on January 14, 2020. The regulations were reviewed by comparison to the equivalent NRC rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2007-2, and 2007-3 as identified in the enclosed State Regulation Status (SRS)

Data Sheet. We discussed our review of the regulations with James Uhlemeyer on February 5, 2020.

As a result of our review, we have five comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Kansas, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Kansas regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. Definition: Consortium Kansas definition of Consortium omits the sentence, The PET radionuclide production facility within the consortium must be located at an educational institution or a Federal facility, or a medical facility.

Kansas needs to add the sentence indicated above to meet the Compatibility Category C designation assigned to 10 CFR 30.4 Definition of Consortium.

2 28 181m(h) 30.32(j) 2007-3 B

Application for specific licenses Kansas equivalent regulations are not essentially identical to NRC regulations as follows:

1) Kansas needs to insert their equivalent regulations to the references noted in 30.32(j),

i.e., in section 181m(h)(2)

Kansas regulations state, evidence that the applicant is qualified to produce radioactive drugs for medical use by meeting the requirements of this regulation; Kansas needs to insert their equivalent regulation to 32.72(a)(2);

and

2) In section 181m(h)(3), Kansas regulations state, and documentation that each individual meets the requirements of an authorized nuclear pharmacist;; Kansas needs to add that they meet the requirements of an authorized nuclear pharmacist as stated in [Kansas

Kansas needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 30.32(j).

3 28-35-181m 30.34(j) 2007-3 B

Terms and conditions of licenses Kansas equivalent regulations are not essentially identical to 10 CFR 30.34(j) as follows:

1) Kansas omits an equivalent provision to 30.34(j)(2)(i) [we note that this regulation is under NRC review at this time];
2) In their equivalent regulations to 30.34(j)(2)(ii), Kansas needs to insert an equivalent provision to the requirement stating, Possess and use instrumentation to measure the radioactivity of the PET radioactive drugs intended for noncommercial distribution to members of its consortium and meet the procedural, radioactivity measurement, instrument test, instrument check, and instrument adjustment requirements in

§ 32.72(c) of this chapter.

3) Kansas equivalent provision to 30.34(j)(3) is not essentially identical, it should read, A licensee that is a pharmacy authorized under § 30.32(j) to produce PET radioactive drugs for noncommercial transfer to medical use licensees in its consortium shall require that any individual that prepares PET radioactive drugs shall be:(i)

Kansas needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 30.34(j).

4 28-35-178i 31.12 2007-3 C

General license for certain items and self-luminous products containing radium-226 Kansas equivalent regulations do not meet the essential objectives of 10 CFR 31.12 as follows:

1) Kansas omits the sentence, For the purposes of this paragraph, "small radium sources" means discrete survey instrument check sources, sources contained in radiation measuring instruments, sources used in educational demonstrations (such as cloud chambers and spinthariscopes), electron tubes, lightning rods, ionization sources, static eliminators, or as designated by the NRC from their equivalent provision to 31.12(a)(5);
2) Kansas omits an equivalent provision to 31.12(b);
3) Kansas omits the phrase, equivalent NRC regulations.

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS Kansas needs to make the changes indicated above to meet the Compatibility Category C designation assigned to 10 CFR 31.12.

5 28-35-181m 32.72(b)(5)(iv) 2007-3 B

Manufacture, preparation, or transfer for commercial distribution of radioactive drugs, containing byproduct material for certain in vitro clinical or laboratory testing under general license Kansas deleted their equivalent provision to 32.72(b)(5)(vi) which states, (vi) A copy of the State pharmacy licensure or registration, no later than 30 days after the date that the licensee allows, under paragraphs (b)(2)(i) and (b)(2)(iii) of this section, the individual to work as an authorized nuclear pharmacist.

Kansas needs to restore the provision indicated above to meet the Compatibility Category B designation assigned to 10 CFR 32.72(b)(5)(vi).
