SUBJECT:
LICENSED OPERATOR ARREST FOR C0 CAINE POSSESSION Your staff at the Catawba Nuclear Plant reported on May 3,1993, that an NRC-licensed operator, who had previously tested positive for cocaine usage, was arrested for possession of cocaine.
Please provide the details of the circumstances pertaining to this occurrence, answers to the questions listed in the enclosure to this letter, and other records and information on this employee's past fitness-for-duty which are relevant to the occurrence.
Any other information that you think is pertinent or useful regarding this incident would be appreciated.
You are requested to submit a written reply to the U. S. Nuclear Regulatory Commission, Region II, within 20 days of the date of this letter.
The information in your reply to this letter will be evaluated to see if further action by the NRC, pursuant to 10 CFR Parts 50 or 55, is warranted.
The information supplied will be maintained in NRC Privacy Systems of Record-16 and will be subject to the Privacy Act.

Duke Power Company is requested to provide the following information concerning the Fitness-for-Duty report of May 3,1993, regarding the involved licensed operator:

Name and responsibilities of the operator involved.

A summary of the operator's entire fitness-for-duty testing history.
i Please include the dates and times the operator was tested, the reasons for j
the tests (i.e. random, for-cause, of follow-up), the results of the tests, l
and the dates that any tests were confirmed positive.

Whether the operator used, sold, or possessed illegal drugs within the f
protected area or outside the protected area.
If so, please provide the i
details of the circumstances surrounding such use, sale, or possession.

If the operator was arrested indicate when and where the arrest occurred.

Indicate whether the operator was involved in a rehabilitation program.
If involved in a rehabilitation program, provide the reason why the operator
-l was in the rehabilitation program. Also indicate if the rehabilitation j
program was a Duke Power Company rehabilitation program or a private-rehabilitation program.

Whether the operator was at the controls or supervising licensed activities while under the influence of cocaine.

Whether the operator was involved in procedural errors pertaining to this incident.

Your intentions with regard to the operator's resumption of duties under the Part 50 and Part 55 licenses, including plans for follow-up testing to demonstrate that the operator has remained drug-free.

If the operator is still employed by Duke Power Company, you are expected l
to review the operator's medical qualifications and are expected to take one of the following two actions:
i (a)
If it is determined that the licensed operator no longer meets the medical qualifications described in 10 CFR 55.33(a)(1), then you i
should notify the NRC via letter of the licensed operator's
}

incapacitation in accordance with 10 CFR 55.25.
For example, a j
notification to the NRC would be required if a determination is made t
as part of your employee assistance program, in consultation with j
your designated physician, that the licensed individual can no longer meet the medical criteria of ANSI /ANS 3.4-1983.

If it is determined that the operator meets the requirements of Section 55.33(a)(1), then you should submit a medical certifica 6 on ti on NRC Form 396 inl order to allow the NRC to confirm that the operator's medical condition meets the requirements of Section 55.33(a)(1).
Your submittal should also include documentation describing the basis regarding the designated physician's conclusion that the individual meets the general health requirements of ANSI /ANS 3.4-1983 and does not have a disqualifying condition under Section 5.3 of that standard.

If the operator is no longer employed by Duke Power Company, you are expected to provide notification to the NRC of licensee termination per 10 CFR 50.74.
