NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Westinghouse Electric Corporation (EA 93-044)

PROPOSED IMPOSITION OF CIVIL PENALTY - $18,750 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $18,750 will be issued on or about April 23, 1993, to Westinghouse Electric Corporation.

This action is based on the licensee's failure to perform a criticality safety analysis prior to using numerous j

non-favorable geometry containers in various plant locations that handle special nuclear material.

The base civil penalty was escalated 50% for NRC identification and 100% for the licensee's prior opportunity to identify the problem through a review of Information Notice No. 89-24,

" Nuclear Criticality Safety."

However, the base civil penalty was mitigated 100%

for the licensee's past good enforcement history.

i It should be noted that the licensee has not been specifically I

informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice April 23, 1993 Telephone Notification of Licensee April 23, 1993 r

The State of South Carolina will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil 1

penalty may be remitted, mitigated, or imposed by Order.
