300 Madison Avenue l

Toledo, Ohio 43652

Dear Mr. Shelton:

l

SUBJECT:

RELIEF FROM ASME SECTION XI REQUIREMENTS FOR VT-2 VISUAL EXAMINATION 0F CLASS 2 PIPING ASSOCIATED WITH CONTAINMENT PENETRATION NOS. 30, 31, 33, AND 34 (TAC NO. M77588) i By letter dated September 28, 1990, Toledo Edison Company requested relief

^

from the ASME Boiler and Pressure Vessel Code,Section XI, requirements for visual examination of portions of Class 2 piping associated with containment i

penetration nos. 30, 31, 33, and 34 at the Davis-Besse Nuclear Power Station, 4

Unit No. I for the first ten-year inservice inspection interval. Guardpipes,

/

rubber foam barriers, and rubber boots prevent access necessary to perform

~!

VT-2 visual exaraination of the containment purge piping associated with containment pen'etration nos. 33 and 34. Similarly, guardpipes inhibit performance of *a VT-2 visual examination of containment penetration nos. 30 and 31. The NRC staff has completed its review of this request. A copy of the Safety Evafuation is enclosed.

Based on our review, we have determined that the VT-2 visual examination of the subject containment purge lines is impractical to perform to the extent required by the Code and that granting relief is authorized by law and will not endanger life or property or the common defense and security, and is otherwise in the public interest.

In making this determination, we have given due consideration to the burden that would result if the Code requirement were imposed on your facility.
