ENCLOSURE 1 NOTICE OF VIOLATION Carolina Power and Light Company Docket Nos. 50-325, 50-324 I

Brunswick License Nos. DPR-71 and DPR-62 i

During NRC inspections conducted on February 8-12, 17-19, 1993, violations of NRC requirements were identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violations are listed below:

Brunswick Steam Electric Plant Technical Specification Section 6.8.1 i

states that written procedures shall be established implemented and

_7 maintained covering the activities referenced below. Item (e) is the Emergency Plan implementing procedures (PEPS).

i Contrary to the above, 10 controlled volumes of the PEPS in the Emergency Operations Facility (EOF) were not maintained in that they contained the incorrect revision of PEP 2.6.21, " Emergency Communicator."

In addition, four of the ten controlled volumes of the PEP in the EOF also contained other procedures with the incorrect revision.

This is a Severity Level IV violation (Supplement VIII).

B.

10 CFR 50.54(q) states that a licensee authorized to possess and operate a nuclear power reactor shall follow and maintain in effect an emergency I

plan which meets the standards in 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.

10 CFR 50.47(b)(8) states that the emergency facilities and equipment to support the emergency response are provided and maintained.

l Plant Emergency Procedure PEP-4.2, " Emergency Facilities and Equipment" states that adequate emergency facilities and equipment shall be maintained and keep operational.

Section 5.2 of the Brunswick Emergency Plan identifies the EOF /TSC emergency diesel generator as EOF equipment.

Contrary to the above, the EOF /TSC emergency diesel generator did not j

have a preventative maintenance program, nor any scheduled maintenance l

program.

This is a Severity Level IV violation (Supplement VIII).

Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the U.S.

l Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C.

20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and' the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
