TROJAN NUCLEAR PLANT REQUEST FOR EXEMPTION FROM 10 CFR 70.24, i

CRITICALITY ACCIDENT REQUIREMENTS (TAC NO. M85852) l By letter dated February 16, 1993, Portland General Electric Company (PGE, the licensee) requested an exemption from Title 10 of the Code of Federal i

Regulations, Section 70.24, " Criticality accident requirements." The staff has completed a review of this request and has concluded that the regulation, 10 CFR 70.24, does not apply under the specific circumstances that now exist at Trojan Nuclear Plant (Trojan). Reasons for this conclusion are as follows:

- PGE has permanently ceased operation of the Trojan Nuclear Plant.

began defueling the reactor on January 23, 1993, and completed movenent of l

all fuel elements to the spent fuel pool on January 27, 1993. By letter l

dated February 17, 1993, the licensee certified that it would not move fuel back into the containment building at Trojan without. prior NRC approval.

- Since no new fuel is present at the Trojan site and none will be moved there in the future, there is no requirement to monitor the unirradiated fuel handling areas of the plant because these areas do not contain and will not contain special nuclear material.

l The basis for the criticality accident monitoring requirements of 10 CFR f

70.24 is the mitigation of the consequences of an inadvertent critical l

configuration of stored nuclear fuel. The spent fuel pool storage racks at Trojan are designed to maintain the effective neutron multiplication factor (k ) for stored fuel assemblies less than 0.95 under both normal and j

ab,n,o,rmal conditions, as detailed in PGE Topical Report PGE-1037, Spent Fuel Storage Rack Replacement Report.

- In support of the permanent cessation of operation of the Trojan Nuclear Plant, PGE developed and submitted to the NRC for approval a Certified Fuel I

Handler program. The report describes PGE's program for the certification of personnel who supervise or perform duties associated with the handling, storage, and cooling of nuclear fuel. The program includes personnel training in radiological safety principles and monitoring as well as plant administrative and safety procedures.

beneath water shielding. Also, the section is not intended to require monitoring systems when special nuclear material is being transported when packaged in accordance with the requirements of part 71 of Title 10 of the l

Code of Federal Regulations.

The absence of new fuel, the design of the storage racks, and the procedural controls over fuel handling activities combined-with Certified fuel Handler training provide adequate assurance against the occurrence of an accidental

.l criticality. Therefore, the staff has determined that 10 CFR 70.24, does not apply to Trojan Nuclear Plant in its current permanently shutdown and defueled

condition. An exemption from 10 CFR 70.24 for Trojan Nuclear Plant is not i

necessary.
