Dear Mr. Gannis:
I am responding to your letter of February 26, 1993, to Chairman Selin, in which you expressed concern about the recent fuel rod failure at the Perry Nuclear Power Plant, Unit No.1, wh.;h resulted in the Cleveland Electric Illuminating Company (the licensee) voluntarily shutting down the plant to replace the defective fuel rod.
The NRC staff shares your concern about finding the cause of the mel cladding leakage (failed fuel). During the plant shutdown to identify and remove all failed fuel rods, NRC staff traveled to the Perry site, and held a public meeting in the NRC Region III office on February 10, 1993, to review the licensee's actions (Inspection Report 50-440/93003 enclosed). At the meeting, the licensee discussed the fuel rod failures at. Perry and its joint task force formed with General Electric Company to investigate the cause of the failures.
The staff found-the licensee's actions to be appropriate, and concluded that the plant could start up and operate safely. While the six fuel rod failures at Perry which have occurred over the past six years are more than similar plants have had, we find that the task force investigation is appropriate, and that it is premature to focus on the Perry plant as the cause of the failures.
As explained to you by members of my staff in a telephone call on March 3, 1993, the safety of the Perry plant to operate with fuel cladding leakage is assured by several means.
First, there are limits in the Perry plant's Technical Specifications for reactor coolant system activity and for radiation monitoring that ensure that the plant will be shut down for failed fuel at a point significantly below the limits for maximum allowed radiation dose.
Additionally, analyses performed to show that the Perry plant is safe to operate conservatively assume many more failed fuel rods than have been observed.
Finally, all fuel rod assemblies at Perry were checked for leaks before the recent plant startup, and of note, the fuel rod that was leaking 91 9303260012 930322 PDR ADOCK 05000440 y

Several other fuel rod assemblies with anomalous indications were removed from the core and replaced with substitute fuel rod assemblies from the spent fuel pool.
In conclusion, we find that operation of the Perry plant will not endanger the public health and safety or the common defense and security.
