Dear Sirs:
Exclusion From Certain Title 10 to the Code of Federal Reculations (10 CFR) Regulations On January 27,1993, Portland General Electric Company (PGE) submitted a License Change Application requesting that the Trojan Nuclear Plant (TNP) Operating License be amended to a Possession Only License (POL). The POL, when approved by the Nuclear Regulatory Commission (NRC), will allow PGE to possess special nuclear, source, and byproduct material but not operate the nuclear reactor.
PGE notified the NRC via letter dated Febmag 2,1993, that the reactor fuel has been permanently off-loaded from the reactor vessel and placed in the spent fuel pool. By letter dated February 17,1993, PGE cenified to the NRC that fuel would not be moved back into the Trojan Containment Building without prior NRC approval.
On the basis of a resiew of 10 CFR regulatory requirements, PGE has concluded that the 10 CFR sections listed in Attachment I will no longer be applicable to TNP upon NRC approval of the POL. The requirements of these regulations are premised on power operation of the nuclear reactor. After receipt of the POL, power operation will be prohibited and therefore the i
regulations stipulated in Attachment I will no longer be applicable.
