COMANCHE PEAK STEAM ELECTRIC STATION (CPSES) - UNIT 1 DOCKET NO. 50-445 NRC INSPECTION REPORT N05. 50-445/93-04; 50-446/93-04 RESPONSE TO NOTICE OF VIOLATION Gentlemen:

TU Electric has reviewed the NRC's letter dated February 4,1993, concerning the inspection conducted by the NRC staff during the period January 4-6, 1993.

This inspection covered activities authorized by NRC Operating License NPF-87 and Construction Permit CPPR-127.

Attached to the February 4, 1993, letter was a Notice of Violation.

TO Electric hereby responds to the Notice of Violation (445/9304-01) in the attachment to this letter.

During an NRC inspection conducted on January 4-6, 1993, one violation of HRC requirements was identified. The violation involved a failure to search packages entering the protected area.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions " 10 CFR Part i

2. Appendix C, the violation is listed below:

t Paragraph 6.2.4.2 of the Physical Security Plan requires that all packages l

will be searched prior to entering the protected area.

l Contrary to the above, on January 5, 1993, the inspector determined-that the f

licensee was not searching all packages' prior to their entering the protected area.

Specifically, the security force trainers were bypassing j

the search equipment at the primary and alternate access points when l

returning gun cases. equipment boxes, and ammunition cases to the armory inside the protected area after conducting range firing training.

RESPONSE TO NOTICE OF VIOLATION l

TV Electric accepts the violation and the requested information follows:

l 1.

Reason for Violation Security training personnel mistakenly believed that if they accompanied and controlled items taken -out of the Protected Area (PA), then those same items would not have to be searched upon re-entry.

In addition, they believed that since the items would be inventoried / searched in the

armory, this verified that no unauthorized contraband entered the PA.

The armory is located immediately inside the entry. turnstiles at the Alternate Access Point (AAP).

Corrective Action Taken and Results Achieved

.s When the violation was reported to Security management by the NRC inspector, the following actions were taken:

a.

The Security Manager instructed the Security training. supervisor i

to stop the practice immediately.

b.

The Security Manager informed contract Security management i

personnel that there are no exceptions to the searching requirements other than those exemptions specifically identified in the Security Plan or Security procedures.

l c.

The Security Chief issued memo BRNS 93023, in conjunction with the Security Manager's memo, to the Security shif t personnel for.the purpose of restating the PA search policy at CPSES.

Corrective Actions to Prevent Recurrence l

Contract Security management has assured the Security Manager that~ items l

brought back from the firing range will be searched at the PA entry points prior to being returned to the armory.
