This letter confirms the granting of a Temporary Waiver of Compl'iance (TWOC) l from the Technical Specifications (TS) requirement contained in the Zion l

Nuclear Power Station, Unit 1, TS Section 3.8.9.b, " Limiting Condition for Operation," (LCO) which requires that if less than one channel of the Containment Recirculation Sump Level. Instrumentation (CRSLI) is-operable,.

i and if a channel can not be restored to operable status within '48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br />,. the reactor must be placed.in at least Mode 4 within the next-12 hours.

A TS amendment was issued on January 27, 1993, with an implementation date of February 26, 1993, that'added certainl instrumentation calibration requirements to Tables 3.8.9-1 and 4.8.9-1;' including a calibration frequency for the CRSLI of 18 months.

Prior to the amendment.being issued, calibration of.these instruments was administratively controlled, with a frequency of 36 months.

At the time of Commonwealth Edison Company's -(Ceco) review of the TS change request in February 1992, the CRSLI were within the proposed 18 month calibration frequency since they had last been calibrated in March 1991.

calibration frequency had been changed,' the CRSLI would have been calibrated during the Unit I refueling outage in the spring of'1992'and, upon

implementation, the CRSLI would have met the requirements of. the: amendment.

Prior to the amendment -implementation date, it was discovered that the Unit I

l CRSLI would not be within the required' calibration frequency upon the amendment's implementation.

In a telephone call on February 25, 1993, the need for this TWOC was discussed with the NRC staff.

This conversation was followed by a letter dated

February 26, 1993, in which CECO formally requested that it be allowed to delay the performance of the Channel Calibration _ requirements of Specification 4.8.9 for the two Unit 1 CRSLI pending issuance of a TS amendment, on a l

routine basis, that grants a one-time extension to the CRSLI_ Channel Calibration requirements until the next Unit I refueling outage, currently scheduled for the fall of 1993, or a forced outage of Unit I to Mode 3 occurs.

I understand that, during the period of time that this TWOC is in effect, Zion i

Nuclear Power Station will take the following compensatory actions to ensure the plant is maintained in a safe and stable condition:

i a.

Containment water level (wide range) instrument channels and refueling I

water storage tank (RWST) level instrument channels shall bc maintained operable in accordance with Specification 3.8.9.

b.

Appropriate operating personnel will be notified to ensure these actions i

are maintained.

In a telephone conversation at 1:45 PM (CST) on February 26, 1993, the NRC staff granted the requested relief.

By copy of this letter, the NRC is confirming the granting of your request for a Temporary Waiver of Compliance j

to delay the performance of the Channel Calibration requirements of Specification 4.8.9 for the two Unit 1 Containment Recirculation Sump Level Instruments pending issuance'of a TS amendment, on a routine basis, that grants a one-time extension to the CRSLI Channel Calibration requirements-until the next Unit I refueling outage, currently scheduled for the fall of 1993, or a forced outage of Unit 1 to Mode 3.

This TWDC is effective j

immediately, to expire at 5:00 PM (CST) on June 30, 1993, which will allcw sufficient time for Ceco to submit, and the NRC staff to review, a TS amendment request for a one-time extension to the Containment Recirculation i

Sump Level Instrumentation Channel Calibration requirements until the next Unit I refueling outage currently scheduled for the fall of 1993.

The NRC's basis for granting this Temporary Waiver of Compliance is its

)

agreement with the CECO determination that the calibration record of the CRSLI is a history of proven reliability. The NRC staff considers it to be in the interests of the health and safety of the public to grant the TWOC to avoid putting Unit I through the unnecessary thermal transient of a reactor shutdown.

Performance of the Channel Calibrations with the reactor at power is also not a desirable option due to the high radiation dose which would be incurred by personnel performing the calibration. To resolve this issue, Ceco has also committed to submit a TS change request by March 5, 1993, that will request a one-time extension to the CRSLI Channel Calibration requirements until the next Unit I refueling outage.
