Dear Mr. Bangart:

As discussed between you and Mr. Khosrow Semnani, Envirocare of Utah, Inc.,

is requesting a temporary exemption from the requirements of 10 CFR 70 to permit the possession ~of U-235 as special nuclear material in excess of the 350-grams.

Envirocare disposes of low specific radioactive material -

primarily soil type with some debris - under a radioactive materials license from the State of Utah.

Because of unloading problems resulting from the extended severe winter weather this year, Envirocare is now faced with a backlog of approximately 80 gondola rail cars in transit, with more being shipped each week.

These rail cars contain sufficient U-235 that, in most cases, only one rail car can be accepted at a time.

This causes long delays _

that prevent a time:ty acceptance and disposal of the contaminated waste.

Because of the 350-gram limit per rail car, the actual concentraticn of U-235 ic limited to cpproximctcly 9 pCi/g of waste, compared to Envirocare's radioactive materials license limit

of 770 pCi/g, based on potential doses to our workers.

Increasing the possession limit will result in no significant increase in radiation exposure to the workers.

Due to the extremely diffuse.

nature of the U-235 contamination in the waste - less than 350 4

grams per 100-ton rail car load, or less than 0.0004 percent -

there is neither any potential for criticality nor for any type of diversion of the U-235.

Based on these considerations, Envirocare is requesting a 30-f day exemption with permission to possess up to 1,050 grams i

undisposed U-235.

This will allow Envirocare to expedite

acceptance and disposal of the backlog and to become current with the continuing shipping schedule.

Because of the need to dispose of this waste as soon as possible, we ask that this request be given your earliest consideration and that it approval _ be expedited.
