NRC INSPECTION REPORT 50-298/93-06

This refers to the inspection conducted by Mr. W. C. Walker on February 1-9,

1993. The inspection included a review of activities authorized for your

Cooper Nuclear Station facility. At the conclusion of the inspection, the

findings were discussed with Mr. R. L. Gardner and those members of your staff

identified in the enclosed report.

Areas examined during the inspection are identified in the report.

Within

these areas, the inspection consisted of selective examination of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

'

Based on the results of this inspection, two apparent violations were

identified and are being considered for escalated enforcement action in

accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions" (Enforcement Folicy), 10 CFR Part 2, Appendix C (1992).

'

The apparent violations involve ineffective corrective actions in response to

the Notice of Violation (NRC Inspection Report 50-298/92-19) addressing the

failure to identify and correct the presence of temporary strainers in- the

core spray system, and the submission to the NRC, in written response to the

above Notice of Violation, inaccurate and incomplete information.

Accordingly, a Notice of Violation is not presently being issued for these

inspection findings.

Please be advised that the characterization of the

apparent violations described in the enclosed inspection report may change and

that additional violations may be identified as a result of further NRC

review.

One apparent violation involves a failure of your corrective action program to

correct a condition adverse to quality for an extended period of time.

We are

concerned that with an NRC Information Notice, and on two separate occasions

of finding temporary strainers in safety-related systems, you have-been

ineffective in identifying and removing all temporary strainers from safety-

related systems and those temporary strainers in nonsafety-related system

'

which might impact on plant safety.

Your reviews were apparently incomplete

and did not reconcile plant conditions with the process and instrumentation

diagrams.

The second violation involves several examples' of a failure to provide

complete and accurate information. As you are aware, the NRC relie's heavily

upon licensee's to provide complete and accurate information in. order to

~

execute its regulatory responsibilities..

In this instance, the information

you provided to the NRC in response to the 1992 Notice of Violation was

apparently inaccurate and incomplete and led the agency to conclude that

temporary r, trainers either did not exist or were highly unlikely to exist.

Examples are provided in the report.

An enforcement conference to discuss these apparent violations has been

scheduled for 10 a.m. March 4,1993, at the NRC's Region IV office.

The

purposes of this conference are to discuss the apparent violations, their

causes, and safety significance; to provide you the opportttnity to point out

any errors in our inspection report; to provide an opportunity for you to

present your proposed corrective actions; and to discuss any other.information

that will help us determine'the appropriate enforcement action inLaccordance

with the Enforcement Policy.

You will be advised by separate correspondence-

of the results of our deliberations on this matter.

No response regarding the

apparent violations is required at this time.

We are also concerned that there were weaknesses in the operability

determination'which was. performed for the Reactor Core Isolation System and'

that no written evaluations were performed for temporary. strainers which were

found in nonsafety-related systems.

Please be prepared to discuss evaluations

of all the temporary strainers that you have identified.

In accordance with 10 CFR Part 2.790 of the NRC's " Rules of Practice," a copy

of this letter and its enclosures will be placed in the NRC Public Document

Room.

Should you have any questions concerning this inspection, we will be pleased

to discuss them with you.
