Dear Congressman Packard:

q 1.am responding to your letter of April 3,1990, regarding a concern that.was expressed by one of your constituents. Specifically, Mrs. Geismar of Mission Viejo, California, questioned why Southern California Edison Co'. (the licensee) requested conversion of Provisional Operating License (POL) No. DPR-13.for San OnofreNuclearStation, Unit 1,toafull-termoperatinglicense(FTOL)..

Between 1969 and 1971, the Atomic Energy Commission (AEC) issued 15 POLS.

These licenses allowed continued. plant-operation while the AEC staff and the licensees evaluated plant operating characteristics and resolved.any generic concerns. The AEC intended to convert these POLS to FTOLs upon-completion of this review process. -The AEC did-not intend the POLS to be permanent licenses and only issued them to allow the facilities an interim period of-operation' In the case of San Onofre Unit 1, the licensee requested that the-AEC convert the POL to an FTOL in July.1970. However, at that time, the AEC staff was still evaluating a large backlog of unresolved generic issues, and_the staff determined that it was not appropriate to convert any of the' remaining POLS:to FTOLs until these issues were resolved.

L In 1977, the U.S. Nuclear Regulatory Connission (NRC) initiated the Systematic l

Evaluation Program (SEP) as a mechanism to review the designs of older operating nuclear reactor plants to reconfirm and document their safety, and it sub-sequently became a prerequisite for conversion of POLS to FTOLs. The review provided the following:

(1) an assessment of how these plants' compare with current licensing safety requirements relating to selected issues; (2) a basis for deciding how these differences should be resolved in an integrated plant review; and (3) a documented evaluation of plant safety. The NRC completed this evaluation for San Onofre Unit 1 and documented the results in NUREG-0829,

" Integrated Plant Safety Assessment Systematic Evaluation Program," dated December 1986.

As a result of the NRC staff's evaluation, a large number of action items were identified for licensee resolution. Although Southern California Edison Co.

has resolved many of these action items, a number of them still require resolution. To facilitate conversion from a POL to an FTOL-for San Onofre

Unit 1, the NRC issued a Confirmatory Order dated January 2,1990, which confirms the licensee's schedule for resolving these FTOL open items.

In the interim, while these FTOL open items are being resolved, the licensee has implemented compensatory administrative controls to assure plant safety. The NRC is satisfied with the licensee's actions in this regard and we believe that the plant is safe to operate while these FTOL open items are being resolved.
