Dear Mr. McGranery:

This letter acknowledges receipt of your submission dated April 5,1990, entitled "Fifth Supplement to the Section 2.206 Request by the Shoreham-Wading River Central School District and Scientists and Engineers for Secure Energy, Inc. in USNRC Docket No. 50-322." In this document, you stated that you are incorporating into your Petition filed pursuant to 10 CFR 2.206 on July 14, 1989, as supplemented July 19, 21, and 31,1989, and January 23, 1990, an enclosed "coment" to the Secretary of the Comission dated April 5,1990 In that "coment," you request the Comission to either (1) deny a request by the Long Island Lighting Company (LILCO) for an exemption from the on-site primary propertydamageinsurancerequirementsof10CFR50.54(w)(1)foroperationof the Shoreham facility)and withdraw its proposal to consider the issuance of this exemption, or (2 announce its inten' ion to defer decision'until after publication of a Final Environmental Impact Statement on the decomissioning proposal.

Based on a are11minary review of the concerns raised in your April 5,1990 letter, we lave concluded that neither of the actions proposed in your request would be appropriate for Shoreham in its present status. Our conclusions are based on the following factors:

1.

The property / accident recovery insurance regulations were implemented to provide an assured source of funds '9r cleanup after an accident at.an operating reactor (52 FR 28963. Aupt 5,1987 and as amended by 52 FR 12163, April 5 1990 The staff finds that the concerns related to cleanupfollowlngan)a.

ccident are not significant in the present status of Shoreham.

2.

The public health and safety concerns are significantly reduced for non-operating plants such as Shoreham.

3.

The staff has concluded that in the light of the present status of Shoreham, there will be no significant environmental impacts resulting from granting of the requested exemption, p%(
