EXEMDTION FROM 10 CFR PART 50, Appendix J - RANCHO.SECO NUCLEAR i

GENERATING STATION (TAC NO. 75510)

In response to your letter dated October 20, 1989, the Commission has issued the enclosed Exemption from the requirements of 10 CFR Part 50, Appendix J for the above facility.

The Exemption allows the facility to discontinue the performance of primary reactor containment leakage testing per 10 CFR Part 50, Appendix J while in the defueled lay-up condition. Prior to any future operation of Rancho Seco, the testing requirements of 10 CFR Part 50, Appendix J will be satisfied.

We have concluded, based en the considerations discussed in the Exemption, that:

(1) there is reasonable assurance that the health and safety of the.

public will not be endangered by this actica, and (2) such activities will not be inimical to the common defense and security or to the health and safety of the public.

l The exemption is being forwarded to the Office of-the Federal Register for publication. The related Notice of Environmental Assessment and Finding of No Significant Impact was published in the Federal Register on March 5,1990, i
