Application to Amend Facility Operating License No. NPF-86 With Regard To Sale and Leaseback Transactions By The United Illuminating Company Gentlemen New Hampshire Yankee (NHY) hereby submits the enclosed application to amend the Secbrook Station Unit No. 1 Operating License.
The purpose of the amendment is to allow The United Illuminating Company (UI) to enter into an arrangement for the sale and leaseback of a portion of their interest in Seabrook Station Unit No. I to certain equity investors.
As discussed in Section V of the application, UI expects to close the sale and leaseback transactions on or about June 28, 1990.
This schedule will secure maximum tax benefits for UI and the equity investors and, therefore, the most favorable rental costs to UI and its ratepayers.
To meet this schedule, it will be necessary to obtain the requisite approvals by June 21, 1990. UI

anticipates approval from the Connecticut Department of Public Utility Control and the New Hampshire Public Utilities Commission by May 7, 1990, i
Accordingly, NHY respectfully requests the NRC to expeditiously notice the amendment request, complete the review necessary to issue the required licensing amendment, and thus permit the closing to occur on or about June 28, 1990. NHY will provide any additional assistance or information that the NRC Staff may require, including the identities of the Owner Trustee and of the equity investors when they become available.
The application and proposed amendment have been subjected to a safety evaluation in accordance with 10 CFR 50.59 and have b9en reviewed and approved by the Station Operation Review Committee and the Nuclear Safety Audit and Review Committee. As discussed in the application, NHY has concluded that the proposed amendment to the operatinB license does not involve an unreviewed safety question.
