NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No.
50-336 Millstone Nuclear Power Station, Unit 2 License No. DPR-65 l
l As a result of the inspection conducted on January 20, 1990 - March 5, 1990, and in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy), the t
following violation was identified.
10 CFR 50.73(a)(2)(1)(B) requires a Licensee Event Report (LER) for any operation or condition prohibited by the plant's Technical Specification.
l Contrary to the above, on February 28, 1989 between 12:25 a.m. and 4:31 p.m., the control room emergency air clean-up system was not aligned to the recirculation mode as required by technical specification 3.7.6.1.a.,
a condition prohibited by the plant's technical specification. As of March 5, 1990, no LER had been submitted to the NRC.
This is a Severity Level IV Violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit to this office, within thirty days of the date of the letter which transmits this Netice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and, (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response
