SUBJECT:

SAFETY EVALUATION REPORT, APPLICATION DATED APRIL 5, 1990 CONTROL OF FUEL ASSEMBLIES

Background

The Tennessee Valley Authority (TVA) is licensed under NRC Materials License Nos. SNM-1861 and SNM-1873 to receive, possess, inspect, and store uranium enriched in the U-235 isotope contained in fuel assemblies and loose rods at Watts Bar Nuclear Plant (WBN), Units 1 and 2.

In the subject application, the licensee has submitted a request to eliminate an existing commitment in the licenses which limits the licensee's control of fuel assemblies.-

Discussion in the subject application, TVA proposes to delete the following commitment in Section 1.4, Transfer of SNM, of both licenses:' '"TVA will not package fuel for delivery to a carrier for transport, except in the event of a. damaged or unacceptable fuel assembly to be shipped back to Westinghouse."

The licensee states that a license amendment is needed to allow the transfer of an unirrad-iated, low enriched fuel assembly containing 2.1 weight percent U-235 to the Sequoyah Nuclear Plant (SQN) for the Unit I refueling outage.

The licensee' adds that Westinghouse is presently unable to provide a. fuel assembly of that enrichment to support this outage.

However, TVA's WBN possesses an unirradiated i

fuel assembly of the required enrichment that can be utilized at SQN and, therefore', allow the licensee to meet its restart schedule.

i The staff believes that the existing commitment in the two licenses is an unnecessary restriction on the licensees control of fuel assemblies' at the Watts Bar Nuclear Plant, Units 1 and 2.

Furthermore, this proposed change will not exempt the licensee from the existing NRC regulations on packaging, receipt, 4

and transfer of licensed material.

Transport of the new fuel assembly to SQN I

will be by Westinghouse in accordance with TVA's Radioactive Materials Shipment Manual and 10 CFR 70.54 requirements.

Conclusion / Recommendation The staff finds that the )roposed change will have no adverse effect on the protection provided for tie public health and safety or the environment.

Approval of the amendment application is recommended.

The Associate Division of Special projects, Region !!, has no objection to this action.
