SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT 50-445/89 23;

50-446/89-23)

This refers to the inspection conducted by Mr. H. S. Phillips during the

period April 5 through May 2,1989, concerning issues associated with the

Unit 1 service water coating removal project and other Code V service pro.

curements. The inspection findings are documented in NRC Inspection Report

'

50 445/89 23; 50-446/89 23 issued January 25, 1990, and were discussed with

you and members of your staff at an exit meeting on May 2,1969, and at an

enforcement conference conducted January 30, 1990, at the plant site.

At the

enforcement conference, you presented a verbal response to the inspection

findings. A copy of the TV Electric slides used in your presentation is

attached.

In our report of January 25. 1990, one apparent violation, failure to provide

accurate and complete information, was identified which was comprised of the

-

following three examples:

1.

In an enforcement conference conducted November 9, 1988 regarding issues

associated with the Unit 1 service water coatings remova,l as documented

in NRC Inspection Report 50 445/88 47; 50-446/88 42, you stated that you

had reviewed other Code V services activities with satisfactory results.

Your internal memorandum, NE 22156, dated September 30, 1988, documented

deficiencies suggesting that these activities were not satisfactory.

2.

Your response to Enforcement Action (EA)88-310 dated February 8,42 and

1989

(issue 6 in response to inspection Report 50 445/88-47; 50-446/88-

the November 9, 1988 enforcement conference) reiterated the finding

that the other Code V service procurements were successfully completed

and documented, agt.in in apparent contradiction with memorandum NE 22156.

3.

You stated curing the enforcement conference that damace to service water

piping did not occur following modifications to the splnblaster. The NRC

inspector reviewed videotapes of this piping which revealed apparent damage.

We have considered the staterents you presented at our meeting of January 30,

1990, and have reviewed docuenentation pertinent to this issue.

example (1) of the apparent violation, we have determined that, although it

i

would have been prudent for you to have presented more detatis of your review

of the other Code V service procurements at the enforcement conference, this

,

!

matter need not be resolved because the underlying concern is addressed by the

j

l

violation cited for example (2), below.

!

,

Regarding example (2) of the apparent violation, we have determined that your

[

i

l

written response to EA 88-310 was deficient in that a broad discussion of the

,

other Code V service procurements was clearly necessary to fully address the

i

generic aspects of the procurement problems encountered in the Unit 1 service

!

water coating removal project. This failure to present complete information is

i

considered a violation of 10 CFR 50.9 as detailed in the accompanying Notice of

Violation.

Since it involves infomatior, of more than minor significance, this

!

j

violation has been classifiec as Severity Level IV.

l

Regarding example (3) of the apparent violation, we conclude that the marks made

by the spinblaster do not constitute damage. Accordingly we have determined

'

that example (3) of the apparent violation does not constitute a violation of

NRC requirements.

i

We have also enclosed the synopsis of the results of Case No. 4 89-013 conducted

'

l

by the NRC's Office of Investigations.

That investiration was conducted to

,

determine whether any members of TV Electric made any false statements to, or

intentionally withheld information from the NRC steff concerning matters

,

related to EA 88-310 and the review of o,ther Code V procurements.

That investi-

l

gation did not find any evidence that TV Electric made any false statements or

'

intentionally withheld information from the NRC staff. However, the information

!

developed during the investigation confirms that more complete information

could have been provided to the NRC staff.

,

'

!

The enclosed Notice of Violation related to the violation of 10 CFR 50.9

discussedabove,emphasizestheImportanceofensuringthattheNRChascomplete

'

information on important issues, particularly those issues related to enforcement

i

actions.

For example, although we concluded that example (1) did not constitute

,

a violation, we believe you could have provided more detailed information con-

i

cerning the results of your review of the other Code V procurements to explain

the context for the service water system coating removal problems.
