April 4, 1990 1he Honorable Alfense M. D'Amato United States Senator Federal Building 111 W. Huron Street, koom 620 Butf alo, hew YorL 14I02 Dear Senator D'Amato I am responding to your letter of karch 7,1990, in which you requested inforsation about the disposal of radioactive waste in New York. The U.$.

Nuclear Regulatory Consnission (kRC) welcones the opportunity to assist you in addressing your constituent's inquiry.

The Low-Level Racioactive Waste Policy Act of 1980 set f orth a federal policy for the disposal of low-level ractoactive wastes.

The legislation miakes each of the 50 States responsible for ensuring disposal capacity for the consercial low-level radioactive waste generated inside its borders. States may do this by themselves or by joining with other States in compacts and establishing regional waste facilities. The $ tate of New York has thus far chosen to handle its own low-level waste and not to participate in a regional compact.

Consequently, the State is currently conducting an analysis of possible sites within its boundaries to determine the best possible location for hosting a low-level waste disposal site.

The chosen site will be required to meet strenuous regulatory requirenents cesigned to protect the public health and saf ety.

Details concerning this process within the State of New York can be requested by writing to:
