On March 25, 1990, your staff requested discretionary enforcement with respect to the Sequoyah, Unit 1. Technical Specifications (155) to allow i
Unit 1 to enter reactor operational Mode 6 refueling operations, without two l
operable source range nuclear instrumentation channels. The unit was shutdown in Mode 5, Cold shutdown, with two of the three available channels inoperable and was meetin for shutdown (g the appropriate action statement for the inoperable channels i.e., Action 5 for TS Table 3.31). Limiting Condition for t
Operation (LCO) 3.0.4 of the TSs does not allow entry of the unit into an
' operational mode' unless the condition for all applicable LCOs are met without relying on provisions in the associated action statements. With the inoperable channels, tie unit could not meet TS 3.9.2 in Mode 6 without relying on the associated action statements.
Therefore, the TSs did not allow the unit to move from Mode 5 to Mode 6 without two operable source range channels.
Your verbal request to waive compliance with LCO 3.0.4 to allow Unit I to enter r
Mode 6 was followed by a letter dated March 26, 1990.
This letter documented i
the justification for your request which was provided to the staff on March 25, l
1990.
Because the Unit I entry into Mode 6 is on the critical path to restart the unit from its Cycle 4 refueling outage and is judged to ae safe as documented in the enclosed Safety Evaluation, we approved the Waiver of Compliance at approximately 8:30 p.m. on March 25, 1990 to allow Unit 1 to enter Mode 6.

1990. Although not required by LCO 3.9.2.,vou consnitted to have two source range channels operable prior to the removal of the reactor vessel head.
