Dear Mr. Denton:
In response to question 311.1, which was transmitted by your letter of.
October 15, 1981, attached are three agreements between Duke Power Company and the Concord Cemetery Association. The agreements dated August 26, 1973 and August 28, 1973 between' Duke and the Trustees for Concord Cemetery Association and the Concord Cemetery Association, respectively, are identical in all material respects. These agreements limit the use which the Concord Cemetery Association can make of the land, totaling six acres, which it.
owns within the exclusion area, and also give-Duke the right.~to control the-activities on that land. lThe agreement dated April 11, 1974 between Duke and the Concord Cemetery Association'provides for the transfer. tio Duke from the Concord Cemetery Association of five of the'six acres of land which'the-Association owned within the exclusion area.
The three agreements, taken together, provide that Duke has the right to control activities on the one acre of land, designated as the Concord Church Cemetery, within the exclusion area.
