Gentlemen:
Your application dated August 27, 1981, requested the Office of Nuclear Reactor Regulation (0NRR) to review proposed revisions to the Trojan Nuclear Plant Physical Security Plan. A Class II fee of $1,200 was remitted with your application in accordance with the requirements of 10 CFR 170.22. Your letter dated October 7,1981, withdrew this application.
Under the provisions of 10 CFR 170.12(a), the USHRC may retain fees for withdrawn applications. However, the ONRR staff have informed us that no fcroal review of your application had commenced when it was withdrawn.
On this basis, we have determined that an exemption purruant to 10 CFR 170.ll(b) from the fee requirements is authorized by law and such exemp-tion is otherwise in the public interest and is hereby granted for your August 27 application. Therefore, we have concurrently authorized the Office of the Controller to refund a sum of $1,200 to your Company.
Refunds are generally made in approximately two weeks.
