1 Trip Report Nevada Program Review Date/ Place:

August 17, 1981 Beatty, Nevada Site August 18-20, 1981 Carson City,-Nevada t

Purpose:

To visit the U.S. Ecology site at Geatty, Nevada and to review the Department of Health regulatory program for the l

site in order to assist the Office of State Programs in its compatibility and adequacy determination.

Our site visit was unannounced in accordance with standard Nevada practice and as recommended and practiced by NRC inspectors.

Our host was Mark Poirier, Assistant Site Manager and Chemical Safety Officer.

Because of personnel shortages and vacations, Mark was also acting Site f

Manager and temporary Radiation Safety Officer.

He seemed knowledgeable and was most cooperative.

Bert Gray, the resident State inspector, also accompanied us during the visit.

2 The site appeared well maintained and no problems were observed.

The-soils from excavating. Trench 22 appeared stable but the height raises questions about stability.and blowing dust.

Some idea of the general appearance of the site, the spoils, and the locale can be seen in the 11 photographs taken.

(See captioned set enclosed.) A copy of a recent map was obtained and is enclosed.

The map reflects trench locations at the site as revised after radar profiling.

Data on trench dimensions was obtained from State files.

(See enclosure 3.)

The new trenches (21 and 22) are 50' deep.

Although the depth raises questions about wall stability and, in the State's view,.about the sparse data establishing the ground water levels - it is efficient use of the land and provides intruder protection.

The stability question is addressed by step about 1/3 the distance down.

The 10' wide step collects loose soil sloughing from the soft materials at grade level.

The volumes of Trenches 21 and 22 is about 3,600,000 + 10,000,000 cubic feet.

The NW corner has sufficient area for two trenches about the same size. Trench 21 is almost filled but only a few packages have been placed in 22.

The question of flash floods was raised.

According to U.S. Ecology, no problems have been experienced to date.

A 2-3' term has been constructed around the 80 acre site.

The entire site (nuclear and chemical) is fenced. A road has been graded around the perimeter just outside the fence.

The berm is next to the road.

The site is also on a slight crest.

' Environmental monitoring data was reviewed.

The data is plotted on graph paper and comoared to action levels.

The only questionable data was explained in terms of unit conversion and dry to ashed weights and in terms of error limits on Eberline tests that are greater than H-3 action limits.

TLD quarterly data typically showed 10-50 mR/ quarter in the administrative areas.

A few fence line data were in the 100-200 mR/ quarter range and could exceed 500 mR/ year if persistent.

They did not appear to repeat.

We also looked at truck and area surveys.

A sample form for documenting-truck surveys is enclosed.

No shipments were received during our visit.

The resident State inspector independently surveys and inspects all shipments to the site.

Department of Health, Carson City, Nevada A copy of the Offf:e of State Programs internal procedures for site wastes and review of Agreement State program for commercial low level waste sites dated 8/26/75 is enclosed.

These procedures were used to identify areas of interest but were not followed item by item.

The Nevada staff provided a detailed look at the site user permitting program.

Copies of the regulations, a statement of public input to the regulations, permitting procedures, application forms, guidelines for assessing penalties, and a sample violation letter are enclosed.

No institutional users have been issued permits.

' Resources devoted to the site licensing program include the. full time resident inspectors, % perscn years of Radiological Health personnel (excluding management, legal, Board hearings etc..)

Funding for regulation of the waste disposal site for FY 1982 is $72,000 including

$25,000 for special studies.

This special studies funding will be used for a geotechnical consultant.

Funding and licensee financial assurances were discussed.

A copy of the

$100,000 surety bond for the Beatty site is enclosed.

This is a voluntary performance bond renewed annually and currently good until 12/11/81. The long-term care funds are not comitted funds.

They were used for the package inspeccion program until funds were budgeted.

Noney from penalities on shippers ($4500 thus far) and the site operator are being added to the fund.

The annual fee from the lease is $20,000 which is placed in the fund.

The fund is administered by Vital Statistics but the Director, Department of Human Resources is legally responsible.

The funds totaled $728,929.55.

The State now has an independent environmental monitoring program.

The samples collected by State personnel are sent to the EPA Environmental Monitoring and System Laboratory in Las Vegas for analysis.

A sample computor generated printout is enclosed. Water, soils, and vegetation are sampied.

The most recent license amendment issued is Amendment No. 5 issued October 26,-1979 to permit the USGS to conduct radar profiles.

copies of the license through Amendment 5 on file. An amendment has been I

drafted to restrict burial depth, segregate chelates, and use 8' trench covers but is still under review.

The renewal license has been drafted and is under review.

Board of Health approval is required before State staff are permitted to let NRC or anyone else review the document.

The Board of Health tried to issue the renewal but does not have the authority.

The Board then ordered the Division of Health to issue the renewal for 3 years.

The time specification was procedurally incorrect.

In a'ddition, the Attorney General filed objections to the Board review that contend that not all information was reviewed and information reviewed was not carefully considered.

A new Board of Health has been appointed.

Hearings on the Attorney General's objections were scheduled I

for October 1, 1981. We do not know whether the hearings were held or-the outcome if. held.

The current lease was enacted May 1, 1977 and amended December 7, 1979.

The amendment raised the annual rental fee to $20,000 and the long term care charges from 13C to 25C a cubic foot effective February 25, 1980.

The May 1, 1977 lease has site closure requirements.

The lease provides that the requirements may be set aside before transfer of the site to the State for care.

The requirements in the lease address:

1.

Burial of all wastes; 2.

Removal of surface structures and equipment; 3.

Decontaminating and decommissio.ing equipment and facilities; i

Backfilling and mounding trenches; 5.

Radiation levies; 6.

Plugging and cnpping wells; 7.

Sealing the east gate; 8.

Alarming the gates; 9.

Repairing the fence; f

10.

Repairing signs; and 11.

Final surveys and reports.

i The lease does not address the costs of closure or make any provision for assuring availability of funds.

No other provision for funding closure have been made.

Other areas addressed in our Branch Position on Low-Level Waste Burial Ground Site Closure and Stabilization and incorporated into the Washington and South Carolina licenses not reflected in the Nevada lesse are mainly the requirements to assess the site and demonstrate that radionuclide releases are and should remain at acceptable levels and the establishment of a buffer zone. Water table levels are not addressed but are not an area of concern for arid sites.

Erosion potential has not been addressed.

Flash floods and wind erosion-l could be of concern.

No requirements are included dealing with trench markers. Transfer of records and data is not addressed.

A long term monitoring program has not been addressed.

Impacts and interaction potential with the chemical site is not included.

The State conducts comprehensive inspections of the site in addition to the full time on-site inspector for checking incoming shipments.

A copy of Appendix A to an NRC memo from the previous program review is enclosed.

The Appendix outlines the inspection topics to be covered each quarter.

The Division of Environmental Protection is responsible for the co-located chemical site.

Little interaction occurs.

No help is available from natural Resources (water resources types) or the state geologic survey.

No studies are currently being conducted at the site.

The USEPA has discussed the possibility of some studies with.U.S. Ecology but nothing has developed.

The USGS program is essentially discontinued.

The trailer has been removed.
