We have received a copy of your application dated April 24, 1981, which was filed with the Office of Nuclear Reactor Re0ulation (ONRR) for review. This application related to the deletion of certain Environmental Technical Specifications for the Prairie Island Nuclear Generating Plant Units 1 and 2.
A Class II fee ($1.200) and a Class I fee ($400) were remitted with your application.
It has been d1termined that fees should not be charged for the deletion of non-radio 1 Nical aquatic LCO's and other non-radiological monitoring requirements in cases where licensees have an effective HPDES oermit.
On this basis, we have concluded that an exemption, pursuant to 10 CFR

170.11(b), from the' fee requirements is authorized by law and such exemption is otherwise in the public interest and is hereby granted for your April 24, 1981 application. Therefore, we have concurrently authorized the Office of the Controller to refund you the $1,600 paid with your application. Refunds are generally processed by the Office of the Controller within a two-week period.
