Appendix A NOTICE OF VIOLATION Boone County Hospitai License No. 24-01565-01 As a result of the inspection conducted on September 24, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified:
10 CFR 71.5 prohibits delivery of licensed materials to a carrier for transport unless the licensee complies with applicable regulations of the Department of Transportation in 49 CFR Parts 170-189.
49 CFR 172.403(a) requires that each package of radioactive material be labeled with a " Radioactive 1, II or III" label, unless excepted from labeling requirements.
Contrary to the above, one package in your shipment No. 1/21579, which arrived at the Richland waste burial site on September 24, 1981, was not properly labeled. This package contained special form radioactive material (brachytherapy sources) and was not exempt from labeling requirements.
This is a Severity Level III violation (Supplement V(c)(3)).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:
(1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or a f fi rmation.
Consideration may be given to extending your response time for good cause shown.

Your shipn.;nt 1/21579 was sent on Septerrber 21, 1981, and received on September 24, 1981.
Inspections revealed the following viola-tions of U.S. Department of Transportation regulations.

Because of the nature of the violations found in this shipnent, authori-zation ta use the Richland, Washington, coamercial low-level waste burial site by Boone County Hospital has been suspended indefinitely.
Shipments in transit prior to September 25, 1981, will be admitted to the site.
Further shipments will be refused pending reinstatement of site use.
