Apperdix A NOTICE OF VIOLATION Northern States Powar Company Docket No. 50-263 As a result of the inspection conducted on Octo'oe-13-16, 1981, and in accordance with the Interfm Enforcement Policy, 43 FR 66754 (October 7, 1980), the following violation was identified:
10 CFR 70.53(a)(1) states: Each licensee who is authorized to possess at any one time and location special nuclear material in a quantity totaling more than 350 grams of contained uranium-235, uranium-233, or plutonium, or any combination thereof, shall complete and submit to the Commission (on DOE /NRC Form-742, ?facerial Balance Report) material balance reports concerning special nuclear material received, produced, possessed, trans-ferred, consumed, disposed of, or lost by the licensee.
Contrary to the above, the licensee failed to report to the Commission receipt of a two curie plutonium / beryllium source received in July 1981.
This is a Severity Level V violation (Supplement III).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:
(1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
