This refers to the inspection conducted by Messrs. J. P. Jaudon, E. H. Johnson,

and L. D. Gilbert of our staff during the perinds August 31 - September 4,1981,

and September 14-18,1981, of activities authorized by NRC Facility Operating

License No. DPR-46, for the Cooper Nuclear Station, and to the discussion of our

findings with Messrs. P. Thomason, L. Lessor, and J. M. Pilant on September 4,

17, and 18,1931, respectively.

Arers examined during the inspection and our findings om discussed in the

, enclosed inspection report. Within these areas, the inspection consisted of

selective examination of procedures and repr.!sentative records, interviews

i

with personnel, and observations by the inty.ectors.

During this inspection, it was found that certain of your activities were

i

not conducted in full compliance with NRC requimments. Consequently,you

i

are required to respond to this matter, in writing, in accordance with the

i

provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations. Your msponse shall be based on the

specifics contained in the Notice of Violation attached to this letter.

,

We should particularly like to draw your attention to item A in the Notice of

!

Violation which resulted from the failure of your Safety Review and Audit Board

(SRAB) to conduct periodic reviews of its audit program to ensure that the

audits are conducted in accordance with the requirements of the Technical

Specifications. We are concerned that failure to meet this requirement con-

tributed to the failure of the SRAB to complete its audit program as scheduled.

We note that your own internal QA department audit of April 1981 identified

this deficiency and that the SRAB has responded to the finding. However,we

should further like to point out that the failure of the SRAB to conduct audits

and review the status of the audit program has been the subject of a previous

NRC enforcement action as noted in paragraph 11 of the attached mport. This

raises the question as to the effectivm3 of your previous actions to cormet 7

this deficiency. In view of this, we W M like you to carefully review this

We have also examined actions you have taken with regard to pmviously

identified ittspection findings. The status of these items is identified

in paragraph 2 9* the enclosed report.

Four new unresolved items are discussed in paragraphs 4, 6, and 8 of the

enclosed report.

In accordance with 10 CFR 2.790 of the Commission's mgulations, a copy of

this letter and the enclosed inspection report will be placed in the NRC's

Public Document Room. If this mport contains any information that you

believe to be exempt from disclosure Jnder 10 CFR 9.5(a)(4), it is necessary

that you (a) notify this office by telephone within 10 days from the date of

this letter of your intention to file a request for withholding; and (b) sub-

mit within 25 days from the date of this letter a written application to this

office to withhold such information. If your receipt of this letter has been

delayed such that less than seven dgys are available for your review, please

notify this office promptly so that a new due date may be established.

Consistant with Section 2.790(b)(1), any such application must be accompanied

by an affidavit executed by the owner of the infomation which identifies the

i

document or part sought to be withheld, and which contains a full statement of

the reasons on the basis which it is claimed that the information should be

withheld from public disclosure. This section further requires the statement

to address with specificity the considerations listed in 10 CFR 2.790(b)(4).

,

The informat'on sought to be withheld shall be incorporated as far as possible

into a separate part of the affidavit.

If we do not hear from you in this

regard within the specified periods noted above, the mport will be placed in

the Public Document Room.
