{{#Wiki_filter:. l l APPENDIX A NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-423 Millstone Nuclear Power Station, Unit 3 License No. CPPR-113 As a result of the inspection conducted August 20-31 and September 1-25, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified: A. 10 CFR 50, Appendix B, Criterion V states, in part, that: " Activities affecting quality shall be... accomplished in accordance with (the prescribed) instructions, procedures, or drawings." The Northeast Utilities QA Program Topical Report, Section 5.2, states, in part, that: "During construction the contractor programs are re-quired to clearly delineate the actions to be accomplished in the'... control of procedures, instructions and drawings and the methods for complying with 10 CFR 50, Appendix B." The NUSCO QA Procedure NQA-1.14 states in Section 6.6.6 that, "itens identified for re-audits are rescheduled in the audit / survey and inspec-tion computer program for the date provided with the assignment of a new audit number by the lead auditor." Contrary to the above, as of September 22, 1981, an adverse finding from QA Audit Report #A40571, which was identified for re-audit, was not re-scheduled in the audit / survey and inspection computer program '.vith ai, appropriate date and number. A rc.iew of the NUSCO audit / surveillance followup schedule, dated September-17,1981, indicated that the adverse finding was closed on May 21, 1981. l This is a Severity Level V Violation (Supplement II) B. 10 CFR 50, Appendix B, Criterion VI states, in part, that: " measures shall assure that documents, including changes, are reviewed for adec,uacy and approved for release by authorized personnel and are distributed to and used at the location where the prescribed activity is performed..." [ Northeast Utilities QA Program Topical Report, Section 6.2.1., states in part: "During design and construction phase, the engineer-constructor, NUSCO contractors, suppliers and engineering service organizations are responsible for implementing measures for review, approval, control and distribution of controlled documents, to ensure they are effectively complying w:th the requirements for document control." The Stone & Webster construction procedure CMP 11.1-9.80, states in part, ...It is required that only properly authorized, up-to-date, applicable documents be used for the field construction effort. Unauthorized, super-ceded, incorrrect or inapplicable documents shall not be distributed..." O!ook PDR

Appendix A 2 Contrary to the above, on September 1,1981, the inspector observed two electricians in the engineered safety features building erecting seismic supports on a cable tray using an unauthorized copier print of portions of design drawing EE-34JA. This is a Severity Level IV Violation (Supplement II). Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) the corrective 5ttps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Aton'.c Ent-cgy Act of 1954, as amended, this response shall be submitted under oatt: or affirmation. Where good cause is shown, considera-tion will be given to (xtending your response time. The responses directed by this Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
