NRC Staff Response To Proposed Schedule for Filing Contentions I.
Introduction On October 19, 1981, the Atomic Safety and Licensing Board (Licensing Board) issued an Order asking for connents by petitioners for intervention and the NRC Staff concerning the schedule proposed by Applicants, in a letter dated October 14, 1981, for filing contentions, for filing responses thereto, and for a prehearing conference. The dates proposed by Applicants are:
(1) that contentions be filed by petitioners by November 16, 1981; (2) that Applicants and Staff file responses to proposed contentions by Demmber 8,1981; and (3) that a prehearing confere7ce be held in Rock Hill, South Carolina during the week of december 14, 1981.
II. Staff Position The NRC Staff has no objection to the schedule as proposed by Appli-cants. The Staff notes, however, that there are a number of petitioners to intervene, none of whom, apparently, have suggested any alternatives to the schedc'ie suggested by Applicants to date. Because of the l

O 1 large number of petitioners and the potentially large number of conten-tions that may be filed, the Staff requests that any schedule adopted by the Licensing Board retain the time interval for responses to contentions (responses to contentions to be filed approximately three weeks from the filing of contentions) and the time interval for commencement of the prehearing conference after the filing of responses to contentions-(prehearing conference approximately one week after responses to conten-tions) suggested by Applicants. These suggested time intervals should allow adequate time for the preparation of appropriate responses on the admissibility of the' contentions proffered and adequate time for peti-tioners to review such responses and prepare to address the admissibility.

III. Conclusion The Staff has no objection to the schedule as proposed by Appli-Cdnts.
In the event an alternate schedule is adopted, the Staff respectfully requests that such alternate schedule retain the time intervals for responses to contentions and commencement of the prehearing conference that have been suggested by Applicants.
