The proposed facilities were to be 'f ocated at Locust Point on the southwestern shore of Lake Erie in Carroll Township, Ottawa County, Ohio, 21 miles 1/
southeas't of Toledo, Ohio.-

.. i portions of the site affected by Davis-Besse Units 2 and 3 construction activities. Subsequently. Toledo Edison Conpany, et al. filed a notion requesting that the hearings on the construction pemit applications before the Atomic Safety and Licensing Board be terminated.
i On August 28, 1981, the Licensing Board issued an order in which it granted Applicants' request (1) to withdraw their application for construction permits for Units 2 and 3 of the Davis-Besse nuclear Power Station; and (2) to teminate the licensing proceeding. The Licensing Board also vacated two partial initial decisions which had paved the way for issuance of the two LUAs and authorized the Director, Office of Nuclear Reactor Regulation to revoke the LWAs.
In addition, the Licensing Board required that the Applicants take the actions proposed to redress the site, which the Board prescribed as conditions pur:uant to 10 CFR g 2.107(a) of the withdrawal of the applications for construction pemits.
By letter dated October 15, 1981 to the Toledo Edison Company, the two LWAs issut.d to the Applicants were revoked.
In acc.ordance with the Applicants' request and the Licensing Board's Order and pursuant to 10 CFR 2.107(c), notice is hereby given that the appli-cation for construction permits for Davis-Besse Nuclear Power Station, Units 2 and 3 have been withdrawn, that the proceeding in this matter is teminated and that the two LWAs issued to the Toledo Edison Company, et al.,

ORDER Upon consideration of the response by both NRC Staff and counsel for Toledo Edison Company, et al. ("the Applicant") to this Board's order of December 31, 1980 in the captioned proceeding and the entire record in this matter, and pursuant to the authority contained in 10 C.F.R. Part 2, it is this 28th day of August, 1981 ORDERED 1.
That the. request of the Applicant that its application for construction permits for the Davis-Besse Nuclear Power Station, Units 2 and 3, be withdrawn is granted. The applicant shall tike the following

- f. ~ The existing topsoif stockpile shall be utilized throughout
~
the site in strategic areas as ground cover for vegetation restoration purposes; g.
Landscaping and vegetation restoration shall enhance the site's natural environment.
In developing the details of this effort, compatibility with wildlife areas adjacent to the site shall be considerei by the Applicant.
h.
The definitive reconditioning plan shall be. based on considerations such tha' the site shall be improved:to a -
condition that shall encourage wiy, life to use the: area; i.
Approximately 100 grout pipes remaining from the remedial grouting shall be cut off and plugged prior to backfilling the excavation;
- j. The groundwater treatment plant shall be mothballed in place.

That the Licensing Board's partial initial decisions, LBP-75-75, 2 N.R.C. 993 (1975) and LBP-78-29, 8 N.R.C. 284 (1978), authorizing issu-ance of two limited work authorizations for the Davis-Besse Nuclear Power Station, Units 2 and 3, are vacated.

On August 28, 1981, the Licensing Board entered an un-publ'.shed order in which it granted the applicants' request (1) to withdraw their application for construction permits for Units 2 and 3 of the Davis-Besse nuclear facility; and (2) to terminate this licensing proceeding.

Accordingly, two partial initial decisions previously rendered by that Boards (which had paved the way for the issuance of limited work authorizations (LWAs) for Units 2 and 3 under 10 CFR 50.10 (e) (1) (3)) were vacated. 2_/

Those partial initial decisions were struck from the Appeal Panel's docket in ALAB-622, supra, 12 NRC at 669.

ORDER PERMITTING WITHDRAWAL 0F APPLICATION FOR CONSTRUCTION PERMITS AND TERMINATING PROCEEDING FOR DAVIS-BESSE NUCLEAR POWER STATION, UNITS 2 AND 3 By Order dated August 28, 1981, the Licensing Board in Toledo Edison Company (Davis-Besse Nuclear Power Station, Units 2 and 3), Docket Nos. 50-500 and 50-501, granted with conditions, the Applicant's motion to withdraw the construction permit applications for Davis-Besse 2 and 3 and to terminate the proceeding. The Licensing Board adopted the post-tion of the Staff in its February 19, 1981 report to the Licensing Board that certain activities to redress the Davis-Besse site be included, pur-suant to 10 CFR 9 2.107(a), as conditions of the withdrawal of the appli-A cations for construction pennits.
In addition, the Licensing Board, consistent with the Staff's recommenda-tion, vacated the partial initial decisions, LBP-75-75, 2 NRC 993 (1975) andLPB-78-29,8NRC284(1978), authorizing issuance of two limited work authorizations for Davis-Besse 2 and 3 and authorized you to:
1) revoke the limited work authorizations issued pursuant to 10 CFR QS 50.10(e)(1) and 50.10(e)(3);
2) cause to be published in the Federal Register in accordance with 10 CFR 9 2.107(c) a notice of the withdrawal of the applications for Davis-Besse 2 and 3.
