Gentlemen:
The purpose of this letter is to closeout an old fee issue relating to your application dated February 23, 1979, for the Vermont Yankee Nuclear Power Station. The application pertained to the deletion of certain non-radiological aquatic limiting conditions for operation and associated monitoring requirements from the Environmental Technical Specifications of License No. DPR-28. The application was completed by the Office of Nuclear Reactur Regulation with the issuance of Amendment flo. 56 on February 22, 1980. A Class III fee of $4,000 was requested by our letters dated liarch 16, 1979 and flay 25, 1979, pursuant to 10 CFR 170.M. By letters dated March 28, June 12, and June 28, 1979, your company provided reasons for not paying the requested fee.
It has now been determined that fees should not be charged for the deletion of non-radiological aquatic LC0's and other non-radiological monitoring requirements in cases where licensees have an effective NPDES Permit. On this basis, we have concluded that an exemption, pursuant to 10 CFR 170.11(b),
from the fee requirements is authorized by law and such exemption is otherwise in the public interest and is hereby granted for your February 23, 1979 application as well as for that related portion of the August 16, 1978 application. Consequently, the requested Class III fee is no longer required, and we consider the matter to be closed.
