Dear Senator Pell:

Chaiman Palladino has requested that I provide you with information relative to the Town Council of Charlestown's concern regarding wnether and under what circumstances, if any, United Huclear Corporation (UNC) could transfer their property in Wood River Junction to either the State of Rhode Island or any agency of the federal government. This information was requested in your letter to him dated August 17, 1981. My staff has discussed this with State of Rhode Island and Department of Energy (DOE) officials and both groups could foresee no circumstance under which they would accept possession of the property and waste.

In fact, the State of Rhode Island has gone on record that it would oppose the transfer to the state. Therefore, there appears to be no basis for the concern.

It is probable that transfer to a federal agency would require special legis-lation. In any case, the state or federal agency, with the possible exception of DOE, would have to obtain a special nuclear material license from the Nuclear Regulatory Commission (NRC) unless the Comission decided to grant a licensing exemption.

In view of the fact that there is so much local public interest in the UNC facility, no such licensing action would be taken by the NRC without prior notification to the public with an opportunity for a hearing.
