Dear Mr. Keppler:
DOCKET NOS. 50-266 AND 50-301 FURTiiER REPONSE TO IE IolSPECTION REPORT NOS. 50-266/81-10 AND 50-301/81-11 P_OINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 This letter is in response to your letter of August 11,1981 in which you reiterate that our failure to report in accordance with the requirements of 10 CPR 50.72 an unplanned reactor trip on May 21, 1981 was and remains an item of noncompliance.
In view of the statements in your August 11, 1981 letter, we regard this event a valid item of noncompliance in that this unplannned trip was not reported as recommended in our guidance as contained in DCSI.12.1.
Corrective action to preclude further noncompliance has included revising the guidelines in DCS 1.12.1 to specifically exclude events of this nonsignificant nature.
An attached copy of Pag 3 of DCS 1/12/1 indicates this change with a change bar on the right in Item No. 7.
This revision was issued on July 28, 1981 and full compliance with our revised guidance was achieved on that date in accordance with our letter response to IE Inspection Report Nos.
50-266/81-10 and 50-301/81-11 dated July 22, 1981.
We continue to believe this reporting scope is supported by numerous previously referenced NRC documents and that 10 CPR 50.72 was written to exclude events such as this reactor trip which presented no irnpact or threat to the public health or safety. The test of " serious events that could result in an impact on public health'and safety" was not met in this case.
Until such time as clearer guidance is providtd from the NRC as to what is considered to be a significant or a serious event, these difficulties in interpretation will exist. Our interpretation is from the Federal Register of February 29, 1980 and Supplement to In'ormation Notice No. 80-06, " Notification of Significant Events", dated July L9,1980. 9110190562 811006 PDR ADOCK 05000266 to pDn SEP.
