Midland Project - Fire Protection Plan Review This letter responds in part to your letter to H. R. Denton dated August 6,1931 on the sa"le subject and docuaents agree 1ents reached nutually witn your staff during the past week in regards to the general approach to reviewing the Midland Fire Protection Plan. The NRC staff agrees with the importance of initiating timel.7 review of your Fire Protection Plan. Revision 35 to the tiidland FSAR was received in July 1981 anc, /omptly disseninated to the cognizant technical reviewers. The review of this document, as well as FSAR Appendix 9A and Section 9.5.1, is under way with a target date of Novenber 6,1981 for prep-aration of a draft Safety Evaluation Report (SER) and Open Items List. A meeting with your staff has been scheduled for October 7,1981 at our Bethesda office to discuss the open items resulting from our evaluation. We will attempt at this time to resolve any misunderstandings relative to the applica-bility to your plant of 10 CFR 50-Appendix R, control room / control cabinet fire definitions and positions and timing of the overall site walkdown of the fire protection system relative to construction progress.

As the result of discussions with your staff, we do not feel that there exists any major disagrement insofar as the need for an e'fective fire protection plan and the process by which that plan will be anproved by the NRC. Our Cheaical Engineering Branch has the lead technical responsibility for this review and has indicated a willingness to expend tk effort necessary to conduct the review in a timely manner and work together with Consu1ers Power Co:npany to finalize the requirements. Ibwever, as stated in our letter dated June 29, 1981, exceptions and alternative positions to Appendix R and BTP ASB 9.5.1 will become conditions of the operating license. Our technical reviewers also maintain the position that the final site walkdawn of the fire protection system cannot be aopropriately conducted until at least 90% of the total required wire and cable is in place.

Prelininary site visits will be scheduled, if appropriate, to aid the technical reviewers in their review and in the resolution of open iteas.
