I.
SECY-81-464/464A - Protection of Unclassified Safeguards Material The Commission by a vote of 5-0* approved publication of a final rule and conforming amendments in compliance with a new Section 147 of the Atomic EnergyAct(PL-96-295).
Commissioner Bradford would not have made the rule immediately effective.
Comissioners Gilinsky and Bradford would have preferred that safeguards information on Category II infomation be protected under Section 147.
The Commission requested that:
1.
the rule be published in the Federal Register; (NMSS) (SECY Suspense:

a public announcement be issued when the amendments are filed with the Office of the Federal Register; (0PA/NMSS) (SECY Suspense:
10/16/81) 3.
guidance document NUREG-0794 be published concurrently with the final rule; and (NMSS) (SECY Suspense:
10/16/81) 4.
copies of the Federal Register Notice be sent to affected licensees and other interested parties and that licensees be encouraged to notify their contractors and local police response forces concerning the final rule.

II.
SECY-80-457/457A/457B - ED0 Delegation of Authority The Commission by a vote of 5-0* approved a final version of Manual Chapter 0103 as revised below:
- Section 201 of th'e Energy Reorganization Act, 42 U.S.C. 55841, provides that action of the Comission shall be determined by a " majority vote of the members present." Comissioner Roberts was not present when this item w6s affirmed, but had previously indicated that he would approve. Had Commirsioner Roberts been present, he would have affirmed his prior vote.
Accordingly, the formal vote of the Commission was 4-0 in favor of the decision.

-paragraph 026 is modified to read " appointing and removing, after consultation with the Chairman, without further action by the Commission, aTT officers and employees of the offices reporting to the EDO except:
Director of Nuclear Reactor Regulation, Nuclear Material Safety and Safeguards, Nuclear Regulatory Research, and Inspection and Enforcement;"
-paragraph 031 is modified to read "all significant questions of policy shall be presented to the Commission for resolution.
With respect to such questions, all major views of the affected offices shall be presented to the Commission." The General Counsel was requested by the Commission to review this modification to determine nhether it is consistent with procedures outlined in the Reorganization Plan.
The General Counsel has advised the Commission that this statement is in agreement with the stated procedures.
-the following sentence pertaining to contracts is deleted from paragraph 032:
" Prior to approval, the Chairnen will consult with the Canmissioners." In lieu thereof, the Chairman will request the views of the Commissioners on contracts greater than $750,000.

The General Counsel is directed to submit a new proposal regarding ED0 rulemaking authority.
