DETAILS 1.
Enforcement Conference Participant The licensee was represented by the following individual:
E. Ekberg, General Manager, Northern California, Smith-Drery Company 2.
Enforcement Conference Ort Septenber 25, 1981 at 1:00 A.M., Messrs. A. D. Johnson, Director, Enforcement and Investiga : ion Staff, Region V, and R. D. Thesnas, Chief, Materials Radiation Protection Section, Region V, held a formal enforcement conference with the subject licensee concerning the snforcement history for the year 1980, and the recent inspection in 1981.
This enforcement ccaference was announced in a letter. to the licensee dated September 17, 1981 scopy attached).
Mr. R. Thomas discussed the enforcement history as well as the results of the recent inspection which involved five items of noncompliance, of which three items were repetitive frem the previous inspection.
A copy of Appendix A of the Notice of Violation is attached to -this report. The concern of the repetitive items of noncompliance was stressed.
Mr. Thomas also discussed the need for a tighter management control program as well as an emphasis on the responsibilities of the radiation safety officer.
Mr. A. Johnson described NRC enforcement policies and procedures and provided the. licensee representat1ve'with a copy of the October,,
1980 Federal Register notice which, states the current policy. Escalated enforcement actions, such as civil penalties, or suspension or revocation of the license.were discussed.
'Mr. Johnson emphasized the need for the licensee to be knowledgeable'of the current enforcement policy.
The licensee was informed that' the Notice of Violation would be the sole enforcement action at this time. However, if the results of an early reinspection show repetition of.these items of noncompliance, escalated enforcement actions may be taken.

Licensee Comments Mr. Ekberg stated that an effort would be made to prohibit items of noncompliance, especially those repetitive in nature. The assignment of an assistant radiation safety officer will assist in the auditing of the overall program.

' Mr. Ekberg also stated that it was his opinion that Item D. of the Notice of Violation was not a valid citation since all quarterly inventory records wers complete to his knowledge.. Mr. Ekberg was told that the citatic,would be withdrawn if he could produce the records in question.
Mr. Ekborg stated that he would find the records and send a copy for our review.
