RE:

In the Matter of diack Fox Station, Units 1 and 2, Docket Jos. STN 50-556 and STN 50-557 Gentlemen:

I have enclosed a Joint Motion to Establish Hear-ing Schedule in this proceeding.

The Motion represents the agreement of counsel for Public Service Company of Oklahoma, the State of Oklahoma, and the Intervenors (Citizens Action for Safe Energy, Mr. Burrell, and Ms. Younghein).

Counsel for the NRC Staff was unable to agree with the stipulated schedule.

I will not presume to discuss the part or parts, as the case may be, of the stipulated schedule which the NRC Staff finds offensive.

However, I request that all counsel for the parties in agreement be permitted an opportunity to reply to the Staff's response to the Joint Motion.

3 I have served counsel for the NRC Staff this date S

by hand delivery.

Therefore, the Staff's response to the

/[

Joint Motion is due, as provided in 10 C.F.R.

Purdom September 25, 1981 Page Two October 12, 1981 (15 days plus the weekend).

However, since the first milestone of the schedule begins to run with filing of the Applicant's PSAR Amendment for TMI-2 matters on October 5, and in the interest of expediting the con-sideration of this matter, counsel for the Applicants hereby moves the Licensing Board to shorten the time for filing the response of the NRC Staff to Friday, October 2.

The Licensing Board has autt-

'y to grant this motion under 10 C.F.R.

S 2.730(c); and to good cause shown, the Motion establishing October 2, 1981, as the date for the Staff's reply to the Joint Motion should be granted.

Sincerely, osep Gallo Counsel for Public Service Company of Oklahoma ec:
