EMERGENCY PLANNING Under date of August 24, 1981, the Commonwealth filed a three-page document entitled " Motion of the Commonwealth to Compel i

Answers to its Second Set of Interrogatories to Boston Edison Company Relative to Emergency Planning '.

In reality, the docu-ment is not a motion to compel answers to interrogatories; rather it is a motion to compel the production of certain documents.

The motion is a speaking motion filed solely "to preserve [the Commonwealth's] rights", Motion at 2, while informal attempts to resolve the issue of the revelation of these documents are carried out.

In addition, the Commonwealth has reserved the right "to submit a brief in support of this Motion".

In light of the uncertain status of thJs motion, the Applicants hereby file this answer saying the motion should be denied merely to prese"ve their rights in the event the Common-wealth elect. to press the motion in the future.

In addition, the Applicants wish to point out that the Commonwealth is seeking production of documents prepared by independent expert witnesses; not for the Boston Edison or Pilgrim II ownership group.

While these Applicants have taken the position that these experts are essentially subject to " party status" discovery insofar r.s they have performed tasks for these Applicants, they are not " parties" in any sense of the word insofar as they have done work or reports (not yet in the public domain) for other of their clienta.

Thus, if the Commonwealth chocses to seek these reports, the procedures governing discovery as to third parties will have to be followed.
