Gentlemen:
In the conferencs n11 of last Friday, September 4, 1981, the Board expla.taed and confirmed your order of September 3, 1981 to the effect that the main seismic witnesses would not be heard at the upcoming September 22, 1981 hearing.
Although we requested the Board to reconsider and to permit l
the Staff witnesses to testify during that week, you indi-cated that you would not grant that relief since to do so would amount to reversing your determination not to hear the Staff l
witnesses before deciding to call your own witnesses, a l
determination which you had not been directed by the Appeal Board to alter.
While we have not abandoned our request to proceed with seismic matters during the week of September 22nd, nor waived any recourse we may have, we must address the schedule for the further proceedings which follow from your September 3rd order and the conference call.

Hooper September 11, 1981 Page Two Accordingly, as we indicated during the conference call we vould do, we have inquired into the availability of our witnesses for the weeks identified by the Board as conditionally available in October, viz:
the weeks of either October 12th or October 19th, 1981.
Ea have learned that several of our witnesses have conflicts for the week of October 19th.
Therefore we strongly prefer the week of October 12th-(Although that week also presents some diffi-culty for one of our key witnesses, we are attempting to work around that problem.)
I should add that most of our witnesses have conflicts for the week of October 26th as well, so that that week (which I do not recall being pre-viously discussed), does not present a viable alternative.
If at all possible, therefore, we respectfully request the Board to establish the week of October 12th as the date when any and all seismic evidence remaining to be heard will be considered.
