20555 Re:
South Carolina Electric & Gas Company and South Carolina Public Service Authority (Virgil C. Summer Nuclear Station Unit No. 1), Docket No. 50-395A To the Commission; Enclosed are a number of documents that Central Electric Cooperative, Inc. (Central), has heretofore been unable to furnish to the Commission in this proceeding.
They include a nu:tber of the documents furnished to the Department of Justice on August 8, 1980.
Central intended to furnish these documents to the Commission and to the parties shortly thereafter.
Eefore Central could do so, however, South Carolina Electric & Gas Company (SCE&G), which is a party to the North Carolina district court litigation for use in which the documents were obtained, filed witu the district court a motion for a protective order proscribing use of the documents outside that proceeding.
Central's counsel, who is also counsel to the plaintiffs in the North Carolina proceeding, felt had ruled on SCE&G' proceed further until the district court constrained not to s motion.
As a result, Central was unable to advance this evidence in support of its petition for a finding of "significant change."
(See Comments of Central, filed August 25. 1980 at p. 14; Letter of Wallace E. Brand, filed September 11, 1980, opposition of Central to Motion of SCE&G to Defer, etc., filed December 9, 1980 at p. 5.
Comment of Central filed January 23, 1981 at p. 5; Central's Amended Petition For Rehearing, filed July 20, 1981 at pp.
13-14.
Exhibits Nos. 12, 19, 20 & 22 contain documents obtained from Virginia Electric & Power Company af ter SCE&G's filed its notion for e nrotective order.
