Dear Mr. Fleischaker:
I am responding to your letter regarding the August 10, 1981 staff briefir.g of the Commission regarding uncontested issues in the Diabic Canyon licensing proceeding and the statement made during the course of that briefing in response tc a question whether Comissioners may meet ex_ parte with parties to the proceeding to ciscuss the Licensing Board's denial of proposed contentions.
The Ger.eral Counsel misunderstood the question and this misunderstanding became apparent immediately following the meeting.
Commission offices were then informed within a few hours of the meeting that it would not be appropriate for them to meet off the record with parties to this proceeding to discuss the denial of contentions.
