Dear Mr. O' Leary:

,.w s-During a recent Big Rock Point Plant site inspection performed by a representative of the Directorate of Regulation, Region III, it was noted that we occasionally raise the set points of the two criticality monitors on the refueling deck to levels above the limits specified by 10 CFR 70.2h(a)(1).

It is specified in 10 CFR 70.2h(a)(1) that criticality monitor-ing devices shall be installed in areas where special nuclear material is handled, stored or used and shall have a preset alarm point of not less than five millirem per hour or not greater than 20 millirem per hour. Occasionally, the background levels exceed the maximum set point 4

allowed by the regulation. This occurs when moving' hot loads to and

..from the fuel pool, when hot material is temporarily stored on the reactor deck and during periods when suspended crud in the fuel poo2 causes a high 1

background until cleanup of the water can be achieved.

In the past, we have raised temporarily the alarm set point during the aforementioned periods of high background radiation levels in the reactor deck area to avoid spurious false alarms. We are in the process of implementing tighter administrative control of these set point changes. These tighter controls will:

1.

Allow increasing the alam set points to levels above those expected during the transfer of loads near the monitors which are expected to produce gamma fields greater than or equal to 20 millirem per hour.

2.

Allow increasing the alam set points to levels of 10 milli-Rem per hour greater than background for periods of time when the fuel l

pool or other temporarily stored material causes background levels to be greater than or equal to 20 millirem per hour.

.0stob r 2, 1973 Subparagraph (d) of 10 CFR 70.2h states, "Any licensee who believes that good cause exists why he should be granted an exemption in whole or in part from the requirements of this section may apply to the Commission for such exemption. Such application shall specify his reasons for the relief requested."

We believe that good cause exists to be exempted from this regulation as described above and hereby request exemption. Normal fuel

. handling activities, except for occasionally causing crud deposition in the fuel pool thus higher than normsl background radiation levels, do not cause background levels to exceed the alarm set points. In addition, the physical configuration of the refueling deck is such that alarms cannot be relocated such that their Lackground radiation levels are sur-ficiently low during the occasions described above without defeating _the purpose of their original installation.
