NfQTICE OF VIOLATJQN Empire Soils Investigations, Inc.

Docket No. 9999-0001 Mechanicville, New York New York License No. 2505-3627 During an NRC inspection conducted by telephone on April 25, 1994, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

10 CFR 150.20 (b)(1) requires, in pan, that any person engaging in activities in non.

Agreement State, at least 3 days before engaging in each such activity, file NRC Form-241 with the Regional Administrator of the NRC Regional Office in which the Agreement State that issued the license is located. The Regional Administmtor may authorize the licensee to begin the activity upon notification by telephone of the licensee's intent to conduct the proposed activity under the genemi license.

Contrary to the above, the licensee began work in Burlington, Massachusetts, a non-Agreement State, on April 22,1994 and continued perfonning work until April 24, 1994, without first obtaining authorization from NRC to perform such work.

This is a Severity LevelIV violation (Supplement VI).

Pursuant to the provisions of 10 Cis.'.201, Empire Soils Investigations, Inc. is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory.

Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region I, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid funher violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Infonnation may be issued t

to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Whem good cause is shown, consideration will be given to extending the response time.
